The ALJ determined that none of the Respondents in the investigation violated Section 337 (19 U.S.C. # 1337). See In the Matter of Certain Cold Cathode Fluorescent Lamp Inverter Circuits And Products Containing Same, Investigation No. 337-TA-666. The ALJ's ruling is merely an Initial Determination on the Respondents' activities as they relate to a single O2Micro patent. If the Commission grants a petition for review, it may affirm, modify, reverse, set aside, or remand all or part of the ALJ's decision in developing the full final determination. The Initial Determination also is not determinative of any of O2Micro's other outstanding patent litigation efforts, and does not apply to the hundreds of other patents in O2Micro's patent portfolio, including the emergent market of LED applications.
History of the case
On December 15, 2008, O2Micro filed a complaint with the ITC requesting an investigation pertaining to certain products by Monolithic Power Systems, Microsemi and ASUSTek, whose products incorporate technology that may infringe on O2Micro's patents and are imported into the United States. The complaint sought an exclusion order barring the importation, sale for importation, or sale after importation of products that infringe on O2Micro's patents relating to certain CCFL inverter circuits, inverter controllers and other technology covered by O2Micro's patents. An evidentiary hearing on the remaining patent was held before the ALJ in October 2009.
